Title IX and Sex Discrimination

Title IX

Title IX, a segment of the Education Amendments of 1972, forbids exclusion on the basis of gender from any education program or activity receiving federal financial assistance.

The University Commitment

The policy of the University is to provide an educational and working environment that provides equal opportunity to all members of the University community. In accordance with federal and state law, the University prohibits unlawful discrimination, including harassment, on the basis of race, color, religion, national origin, gender, including sexual harassment, age, disability, citizenship, and veteran status. Procedures for filing discrimination complaints on the basis of gender, including sexual harassment, are addressed by Handbook of Operating Procedures Section 2.2.4. Pursuant to University policy, this policy also prohibits discrimination on the basis of sexual orientation, gender identity, and gender expression.

The University of Texas – Pan American is committed to maintaining a learning environment that is free from discriminatory conduct based on gender. As required by Title IX, the University does not discriminate on the basis of sex in its education programs and activities, and it encourages any student or non-student who thinks that he or she has been subjected to sex discrimination, sexual harassment (including sexual violence) or sexual misconduct by another student, member of the faculty or staff, or campus visitor or contractor, to immediately report the incident to any of the individuals persons or offices listed below.

The University encourages students to immediately consult with or report incidents of sex discrimination, sexual harassment (including sexual violence) or sexual misconduct to the Title IX Coordinator or Deputy Title IX coordinators for reports related to student victims or issues.

Students may also report incidents of sex discrimination, sexual harassment (including sexual violence) or sexual misconduct to any university administrator, official or unit supervisor, who is then responsible for promptly notifying any of the above Title IX coordinators of the reported incident.

Complaints or allegations of student-on-student sex discrimination, sexual harassment (including sexual violence) or sexual misconduct will be handled by the Office of the Dean of Students. Students may also contact the U.S. Department of Education, Office for Civil Rights (1-800-421-3481) to complain of sex discrimination or sexual harassment including sexual violence.

Cases of sexual violence may also be reported to the University of Texas-Pan American Police Department (UPD), the City of Edinburg Police Department (EPD) and other local law enforcement authorities. The Title IX Coordinators can assist individuals with contacting these law enforcement agencies. Complaints of sex discrimination, sexual harassment (including sexual violence) or sexual misconduct by non-students will be handled by Alicia Morley.

The University of Texas-Pan American seeks to provide fair and objective procedures for hearing student complaints and endorses compliance with the spirit of Students are protected from coercion, intimidation, interference, harassment, retaliation, or discrimination for filing a complaint, or assisting in an investigation. Students may pursue complaints through the Office of the Dean of Students.
