Consulting Contract Guidelines
General
Consulting Contracts require special processing. All consultant contracts must be processed by the UTPA Contracts Office. Contracts Office will determine what documentation must be submitted by the requesting department as detailed in accordance with UTS 128 Consulting Policies and Procedures Guide.
The State’s definition of a Consulting Service is as follows: ‘the service of studying or advising a state agency under a contract that does not involve the traditional relationship of employer and employee; services which include the study and advice with respect to some aspect of an agency’s operations or management.”
Limitations on Who May Be a Consultant
An individual who has been employed previously by the institution within the past twelve months may not be hired as a consultant if appropriated funds are used to pay the consultant. Reference: Texas Government Code § 2252.901.
In addition, there are certain disclosure requirements applicable to a proposed consultant who was previously employed by the institution during the preceding two years. Reference: Texas Government Code § 2254.033
